The contract
The franchise contract tends to be signed immediately after the initial training course. In the clauses, mention is frequently made of the franchise manual, the content of which is of obligatory compliance. Its regulations affect not only the physical requirements of the franchise, such as the offices, their location, structure and decor, the furniture and equipment, but also the duties that the Franchisee must undertake, the promotional resources at his/her disposal, the Agency coordination and corresponding procedures.
The contract reflects the obligations of both parties, of note amongst those of the Franchisor are those inherent to Patent Attorneys, such as the processing, maintenance, monitoring and defence of the rights of clients, with the Patent Attorney being the one who acts in name and representation of same with exact submission to legislation and the Law, and with the responsibility inherent to this profession. For the undertaking of these duties, the Patent Attorney has the legal obligation to maintain a valid civil liability insurance policy and have funds on deposit.

Training
The training of the Franchisee begins at with the pre-contract training course. Three are the training aspects impartedn:
1. Administrative training. Covers everything relating to the national and international processing of registration applications, their maintenance and monitoring.
2. Technical training. Principally the expertise relating to the rights conferred by the registration of patents, trademarks and designs, in both Spain and abroad.
3. Sales training. Designed specifically for the Industrial Property sector, but with the additional inclusion of marketing and other sales techniques.
Subsequently, the Franchisee will have to participate in diverse specific courses on patents, licences, designs, private international law, etc. for the purposes of extending or refreshing their expertise.
The job
At the job of the Franchisee is identified with that of Patent Attorneys, wherein of utmost importance is professional confidentiality, fundamental pillar upon which the Agency rests.
The principal activity to be undertaken by the Franchisee is the promotion of and the recruitment of new clients. To do so there are various possible courses of action:
1. Mailings, aimed principally at start-up companies. This first contact with new companies, needing distinctive signs to introduce their products or services to the market must be followed up with subsequent telephone or personal contacts.
2. Collaboration with other business consultancy professionals. This is a very effective course of action, as business Consultants are very familiar with the needs of their clients.
3. Direct contact with businesspeople.
Other activities include constant communication with the Agency, the effective fulfilment of all procedures and on-going attention to responsibilities. |
